    Feature your ad in the monthly Billionaires’ Bulletin Board Newsletter, which will be disseminated to our database of UHNWI (2000+ billionaires, 1500+ centi-millionaires, 6500+ multi-millionaires). It will include a thumbnail of your ad, a title, subtitle, description and a link to your ad page on the BBB platform.

  • A syndicate is a powerful tool for selling high-value goods and services by engaging multiple clients simultaneously in a transaction.

  • Monthly:

    Standard placement durations last for one month, with automatic renewal occurring every 30 days. The subscription will continue unless and until you cancel your subscription, or we terminate it.

    Semiannual:

    Secure an advertising slot in a specific category on the BBB platform for a duration of 6 months. Your subscription will be automatically renewed every 6 months.

    Annual:

    Secure an advertising slot in a specific category on the BBB platform for a duration of 12 months. Your subscription will be automatically renewed every 12 months.

  • BBB platform

    We offer three subscription levels for placing ads:

    Monthly $100 per month.

    Payment is conducted via subscription and can be canceled at any time.

    Semiannual $960 every 6 months (20% off).

    In case of early termination of the subscription, prepaid funds will not be returned.

    Annual $780 every 12 months (35% off).

    In case of early termination of the subscription, prepaid funds will not be returned.

    Ad Featuring

    The cost to feature your ad in a monthly newsletter is $500.

  • Monthly Subscription

    Each new fully paid payment cycle grants the opportunity to partially or fully update ad content within the originally selected ad category*.

    Semiannual and Annual Subscription

    For advertizer who subscribed on Semiannual and Annual programs, a monthly opportunity will be provided to partially or fully update their advertising content within the originally selected ad category*.

    *To place a new or updated ad in another advertising category (for example, if you originally placed your ad in the Yacht category and then, in the following month, decided to place another ad in the Aviation category), you will need to purchase a separate subscription.

  • We retain the right to decline advertisement publication if the content is deemed incompatible with our Advertising Terms of Service, UHNWI data Terms of Service, Content Guidelines and Listing Quality Policy.

    Please note: In the event that an advertisement (which is subject of prior internal approval, see Content Guidelines) is placed on the BBP platform without prior review and subsequently rejected during our internal review process, the payment will not be refunded.

  • Advertisements will be posted within three working days upon receipt of the placement application, full payment, and formal confirmation of design and layout by the advertiser. Notification emails will be dispatched upon ad publication.

  • Updates and Changes

    To make an update or any changes in your Ad after publication please contact our advertising department who will do it for you at advertising@uhnwidata.com.

    Remove from Ad from BBB platform

    To remove your Ad please send request to remove_my_ad@uhnwidata.com.

  • We unfortunately cannot offer refunds or partial refunds. Because this product is nonrefundable, and we cannot adjust your Ad Placement Program (up or down) during the advertisement period, we encourage you to carefully consider the Ad Placement Program you would like to exercise before you select and purchase. You’ll be able to change Ad Placement Program if you choose to renew your relationship with BBB platform after the end of previously picked advertisement period (Monthly, Semiannual and Annual).

    Please note: In case of early termination of the Semiannual and/or Annual subscription, prepaid funds will not be returned.

  • Access to advertisements on our platform is restricted to registered members who meet BBB's platform requirements and have paid membership fees. It's important to note that publishing fees for ads are distinct from membership fees. Advertisers can access the BBB platform (this includes access to their own published ads) only after registering as a member. If an advertiser does not meet the membership requirements, they will not be able to access the BBB platform.

  • Potential buyers will reach out to you via phone or email, displayed in the contact box on your listing. Emails will be sent to the address you have on file in your BBB account, so be sure to double check the appropriate email is linked to your account! Regularly check your inbox and any additional folders you have, as these emails might filter to different folders depending on your email settings.

  • We dedicate considerable resources to promote this distinctive advertising platform, aiming to attract a target audience with substantial purchasing power relevant to your interests. Consequently, each month, our newsletters, strategically designed to draw the desired demographic, reach over 2000 billionaires, 1500 centi-millionaires, and 6500 multi-millionaires.

  • Users of the UHNWI data Ad services (including all properties operated by UHNWI data ("UHNWI data") under the Billionaires' Bulletin Board brand ("BBB")), related data and/or related services (collectively, the "Services") acknowledge and agree to comply with the following Listings Quality Policy (the "Policy"). BBB reserves the right to remove any content that violates any of UHNWI data's Terms of Use, policies or is otherwise inappropriate.

    1. Advertising and Claiming Listings

    a. Listings by Owners: Acceptable verification of ownership of Tangible or Physical Assets, Properties or Collectables could be requested before any listing can be advertised. If complaints are received about a listing, it will be removed from BBB without prior notification and the owner account will be suspended. Listings by owners also must comply with the BBB Advertising Terms of Service.

    b. Brokerages:

    i. License Requirement: UHNWI data reserves the right to request official documents for verification purposes.

    ii. Exclusive Listings: BBB only accepts sale listings that are exclusive or co-exclusive. Listings may only be advertised by a Listing Agent who is the contracted, exclusive listing agent for a listing. Multiple Listing Agents may be shown on a single listing, but there should never be more than one copy of an active listing advertised by the same firm.

    1. Co-Exclusive Listings: The only time two copies of the same unit may be shown is when there is a legitimate co-exclusive agreement between two different brokerages. In the case of a co-exclusive, each brokerage will have its own separate listing for the specified unit.

    2. Verification: If BBB is unable to verify an exclusive agreement, we may remove the corresponding listing at any time without warning. In the event the owner of a listed property has represented to BBB that it’s exclusive agreement with brokerage has been withdrawn and subsequently replaced with an exclusive for a separate brokerage, BBB reserves the right to restrict advertising permissions and/or access for the listed property in question based on the direction of the owner.

    c. Management Companies: BBB requires all listings to include the full name and correct contact information of the corresponding management company. BBB reserves the right to request official documents for verification purposes.

    2. Limitations on Self Promotion and Marketing

    a. All advertising materials must comply with the BBB Advertising Terms of Service.

    b. BBB may restrict the inclusion of self-promoting information or branding on listings and professional profile pages. This includes, but is not limited to, self-promotion on photos and media, in names, website URL and/or in listing descriptions. Providing direction on who to contact and how to contact them is classed as self-promotion and not permitted.

    c. Photos and Video. You may not include marketing information, including, without limitation, a Seller's name, company name, logo, website URL, phone number and/or email address on listing photos or in videos, whether as text, a watermark, or otherwise.

    d. Listing Descriptions. You may not include marketing information, including, without limitation, a Seller's name, phone number, website URL, and/or email address within a listing description.

    e. Profile Name and Photo. You may not include contact information or any promotional or marketing information (including a phone number, email address, website URL, promotional tagline or slogan, or discount offer) in your profile photo or as part of your name as it appears in your profile. Your name as it appears in your profile may not include titles, descriptions, or any information other than your name or your business or team name. You may not display a business or team name in your profile other than the official business or team name under which you formally provide services to clients on BBB. UHNWI data may require you to provide documentation to support the foregoing.

    3. Listing Accuracy

    a. Complete Data Set: BBB requires full information accordingly with applicable fields in the application form. We reserve the right to seek validation that the information is accurate, including but not limited to compliance with the Offering Plan. Complete information is required to improve transparency in the marketplace and for BBB to investigate listings and maintain listing quality. If BBB is unable to verify a listing, we may remove the listing at any time without warning. If there are repeated issues with an advertiser posting listings with inaccurate information, their BBB account may be placed on probation or suspended.

    b. Listing Updates: It is imperative that the status of each listing is accurate. If your account misleads users about the status or availability of your offering, we may prevent you from posting listings on BBB.

    c. Sale listings: The details for each sale listing should be verified on BBB every 30 days, if no updates have been made during that time. By verifying the listing, the Advertiser is confirming that the listing is still available and active on the market.

    d. Photographs: Photographs for all promoted tangible or physical assets, products, properties, collectables (collectively, the "Listing Items") should be the actual photos of Listing Items not generic or AI generated images. In the event that photographs of the actual Listing Items are not available representative photos may be used under the conditions that the representative photos contain the same characteristics as the actual Listing Items. Once these conditions are met, the photos may be used so long as the Advertiser clearly and conspicuously notifies users in the listing description that the photographs in the listing are representative and not of the actual unit.

    4. Compliance

    BBB reserves the right to remove any content we feel is discriminatory and/or inconsistent with our Listings Quality Policy, and, if we deem necessary, restrict access to BBB to users who violate our policies.

    In the event that BBB discovers a violation of any of UHNWI data or BBB’s terms of use or policies as well as any applicable law, rule or regulation, we may remove all or certain portions of your listing/s from the Services, terminate your account(s), and/or restrict your access to the Services. Listing managers/Advertisers are responsible for all activity associated with their company’s account. If you post prohibited listings, fraudulent/suspicious listings, duplicate posts, fake images, or other inaccurate or misleading content, or we receive user complaints regarding your listings, or your behavior related to listings advertised on BBB, we may suspend your account. Use of the Services is also subject to the UHNWI data Terms of Use and policies, including, without limitation, the UHNWI data Listings Quality Policy.   • Introduction

    Here at UHNWI data, our goal is to provide an advertising program that serves the best interests of our advertisers and our users. For this reason, the advertising accepted on our site is held up to high standards, and our policies reflect that. We reserve the right to use our editorial discretion when determining which advertisements may appear on our site. Below, you’ll find our general advertising guidelines and our advertising content policy.

    General Advertising Guidelines

    The advertising content must be clearly identifiable as an advertisement.

    The advertiser must fulfill the advertised offer as stated in the advertisement including, without limitation, not altering any offer periods, product offers, or prices that are stated in the advertisement.

    Advertisements cannot mislead the user.

    For example, ads may not mimic or resemble Windows/Mac/Unix dialog boxes, error messages, or the like.

    Advertisements cannot solicit or collect, or appear to solicit or collect, any personally identifiable information from UHNWI data users without their knowledge.

    Advertisements cannot mimic UHNWI data user experience (look and feel, buttons, etc).

    Advertisers who do collect information from customers must include a prominent link to their privacy policy on their Website.

    Click-through URLs:

    Cannot launch stand-alone video/audio players or otherwise display content outside the standard browser window.

    May not result in the launch of multiple browser windows.

    Advertisements may not discriminate in the sale and service providing, and in other promoted transactions, based on race, color, national origin, religion, sex, sexual orientation, familial status and handicap as specified in all applicable state, local and international laws.

    For banner ads, advertisements must contain the advertiser’s company name or logo.

    All advertising will be reviewed to ensure that it conforms to the UHNWI data content policy detailed below, as well as our Terms of Use. Please see below for specific Showcase Ads image guidelines.

    Advertising Content Policy

    The following subjects are either expressly forbidden or allowed under very limited circumstances. This list is not comprehensive, but should give you an idea of the sorts of ads you won’t find on UHNWI data.

    Aids for Passing Drug Tests

    Advertising for aids to pass drug tests, as well as advertising for sites that promote these products, is not permitted.

    Fireworks/Pyrotechnic Devices

    Any advertising that promotes fireworks and/or pyrotechnic devices is not permitted.

    Hacking and Cracking

    Advertisements that promote hacking or cracking are not permitted.

    Non-accredited Universities

    Life experience is valuable, granted, but only accredited universities may advertise on the BBB platform.

    People Finder Services

    Advertising promoting people finder services and other similar services may not be posted.

    Political Content

    Permitted: Advertising content that promotes political advocacy. Not permitted: Any advertisements that exploit divisive political issues for profit.

    Prescription Drugs and Related Content

    Advertising promoting medical or pharmaceutical products and pharmacies are restricted according to applicable laws.

    Profanity

    No, we won't resort to washing your mouth out with soap. However, any content considered profane will not be permitted in our advertisements.

    Religious Content

    Advertisements that use religious symbols, rituals, or texts in a mocking or offensive manner are not allowed.

    Satellite television service providers

    We do not accept advertising from satellite television service providers. We also do not allow any person or entity who sells satellite receiving equipment or services to advertise satellite television services.

    Slanderous, Libelous, or Defamatory Content

    We do not allow advertising that features or promotes slanderous, libelous, or defamatory content.

    Software and Dialers

    The promotion of software such as dialers that activate without a user’s express consent is not permitted.

    Spam/Bulk Marketing

    We do not allow the advertising of bulk marketing products in which the stated or implied use is for unsolicited spam — including email lists (non-opt-in) and bulk messaging and email software.

    Traffic Devices

    Promoting services, devices, or methods to aid in avoiding traffic tickets is not permitted in our advertising.

    Trademarks

    Advertisers are responsible for appropriate use of trademarks. Use of third party trademarks in advertisements must be lawful and accurate, such as where the advertiser is a lawful reseller of the third party’s good or services.     Video Descramblers

    The promotion of devices used to descramble satellite and/or cable signals is not allowed.

    Violence

    Any site that promotes or glorifies violence and suffering, or features graphic images of the same, may not advertise on BBB platform.

    Advertising that is placed only after prior approval.

    Please note: In the event that an advertisement is placed on the BBP platform without prior review and subsequently rejected during our internal review process, the payment will not be refunded.

    Adult/Sexual Content

    We do permit advertisements and corresponding landing pages containing sexually explicit material, as well as advertisements promoting websites primarily focused on adult content. This includes advertisements for escort services, strip clubs, luxury brothels, VIP fixers, matchmaking, and dating. However, such content is subject to thorough prior review. Please contact us at advertising@uhnwidata.com to validate your content before placing the advertisement. In the event that an advertisement is placed on the BBP platform without prior review and subsequently rejected during our internal review process, the payment will not be refunded.

    Drugs and Drug Paraphernalia

    The advertising of recreational drugs and drug paraphernalia is highly contentious and governed by numerous regulations and prohibitions. Nonetheless, there are avenues to promote such content in regions where these products are decriminalized or legally permitted, and there exist methods to advertise these products in a manner consistent with the law. To ascertain compliance with legal standards or to seek guidance on permissible advertising formats, please contact us for further assistance at advertising@uhnwidata.com. In the event that an advertisement is placed on the BBP platform without prior review and subsequently rejected during our internal review process, the payment will not be refunded.

    Gambling Content

    The advertising of gambling is subject to regulation by various state, local, and international authorities. While we permit advertising that promotes gambling, wagering, luxury casinos, services catering to high rollers and whales, and private poker clubs for high-stakes players, such content is subject to meticulous prior review. Please contact us at advertising@uhnwidata.com to validate your content before placing the advertisement. In the event that an advertisement is placed on the BBP platform without prior review and subsequently rejected during our internal review process, the payment will not be refunded.

    Solicitation of Funds

    Only government-registered charities, political organizations, venture capital firms, well-established entrepreneurs, and duly registered financial organizations are authorized to solicit funds in advertising at BBB platform.     Weapons

    In certain jurisdictions, the advertisement of weapons may be restricted by law, and therefore it is imperative for us to remain compliant. While we do not inherently oppose such advertisements and generally permit the advertising of weapons for personal protection and hunting on the BBB platform, we kindly request that you contact us at advertising@uhnwidata.com prior to placing your ad to ensure that all necessary measures are taken to address any legal considerations.

    Webcams/Surveillance Equipment

    We permit advertising for manufacturers and services that promote webcams or other surveillance equipment for legitimate or special use matters only.

    If you encounter uncertainty regarding the approval of your advertising content on the BBB platform despite the absence of explicit prohibitions or limitations, we encourage you to reach out to our advertising department at advertising@uhnwidata.com for supplementary guidance. It is pertinent to emphasize that we operate under strict confidentiality, and our team possesses extensive experience across diverse advertising landscapes. Thus, it is advisable to seek professional advice in advance to mitigate the risk of advertising without prior approval and potential financial loss.

    Showcase Ads Image Guidelines

    • The maximum dimensions allowed for the image is w800 x h400 pixels.

    • The best aspect ratio for a Showcases Ads image is 2:1 (width:height). This will fill up the image space in the ad most effectively.

    • The largest file size that can be uploaded is 10 MB.

    • Our photo upload feature supports a number of image formats, including JPG, JPEG, PNG, GIF and TIFF. (Note: LAB color space is not supported.)

    To upload a photo, you must have all necessary rights to use the photo in this way, and to grant UHNWI data the rights in the Showcase Ads terms.

    All photos and images must conform to BBB’s ad content guidelines listed above.

  • IF YOU RESIDE IN THE UNITED STATES, PLEASE NOTE: SECTION 13 OF THESE TERMS OF SERVICE CONTAINS AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER. IT AFFECTS HOW DISPUTES WITH UHNWI data ARE RESOLVED. BY ACCEPTING THESE TERMS OF SERVICE, YOU AGREE TO BE BOUND BY THIS ARBITRATION PROVISION. PLEASE READ IT CAREFULLY.

    These UHNWI data Advertising Terms of Service (the “Terms of Service”) govern participation by customer (“Advertiser” or “you”) in many different advertising programs pleased on UHNWI data’s platform “Billionaires' Bulletin Board” (BBB), some of which are specifically discussed herein (each, an “Ad”, collectively, “Ads”) offered by UHNWI data. (“UHNWI data”), upon Advertiser placing an ad order (“Ad Order”) with UHNWI data. The Terms of Service and the Ad Order, together, are referred to as the “Agreement”. Regardless of whether Advertiser places an Ad Order via a UHNWI data website (including “opting in” to an Ad program), via phone with UHNWI data inside sales, or otherwise, Advertiser is purchasing the Ad directly from UHNWI data and Advertiser agrees and acknowledges that this Agreement applies. Advertisers shall protect any Advertiser password(s) and take full responsibility for the use of Advertiser account(s) on any of the services offered by UHNWI data (the “Services”).

    1. Policies.

    (a) General Policies. Advertiser shall comply with the UHNWI data Terms of Use, Privacy Policy, Advertising Content and Image Guidelines, UHNWI data Listing Quality Policy, and other policies and requirements published by UHNWI data from time to time (collectively, “Policies”). The Policies are incorporated by reference herein and UHNWI data may modify the Policies at any time. To the extent there is an inconsistency between a term in this Agreement and a term in the Policies, the term in this Agreement will govern. UHNWI data reserves the right to refuse an Ad Order for any reason and to discontinue displaying and advertising in the event that Advertiser violates the Policies or this Agreement.

    (b) Code of Conduct. UHNWI data believes that all people deserve to be treated equally and with respect, regardless of their race, ethnicity, nationality, class, religion, belief, sex, language, sexual orientation, gender identity, age, health or other status. UHNWI data chooses to work with professionals who both share these values and embody them in their interactions with consumers, UHNWI data employees, and other professionals. In the event UHNWI data determines Advertiser is not upholding these values, UHNWI data may take action to ensure the integrity of the Services, including terminating Advertiser’s Ad program. UHNWI data may also terminate an Advertiser’s Ad program in the event the Advertiser is charged with or convicted of a crime, or UHNWI data otherwise believes Advertiser’s participation on UHNWI data’s platform(s) could harm the reputation and/or good standing of the services offered by UHNWI data.

    2. Billionaires' Bulletin Board Ad Program.

    (a) License in Advertising Materials. Advertiser hereby grants to UHNWI data a royalty-free, perpetual, nonexclusive, fully sub-licenseable right and license to copy, modify, display, distribute, perform, create derivative works from, store, and otherwise use and exploit, all Advertising Materials in any form, media, software or technology of any kind to be used only on or in connection with the web sites and other properties that are owned, operated or powered by UHNWI data, or by its authorized licensees (collectively, the “UHNWI data Network”). For purposes of this Agreement, “Advertising Materials” includes all data and other information provided by Advertiser to UHNWI data in any form, including, without limitation: (i) each property listing, including the corresponding data, information, photos, videos and any other materials (each, a “Listings”); (ii) any other materials submitted to UHNWI data by Advertiser for inclusion in an Ad, including, without limitation, photos, videos, information, URLs, and other content, whether generated by or for Advertiser; and (iii) the web sites and landing pages to which Advertising Materials link or direct users, and the advertised properties and services on such pages.

    (b) Advertising Materials.

    (i) Advertiser Responsible for Advertising Materials. Advertiser is solely responsible for all Advertising Materials submitted to UHNWI data and represents to UHNWI data that Advertiser is authorized to act on behalf of and has bound to the terms of this Agreement any third party for which Advertiser places Ads. Advertiser is responsible for promptly updating Advertiser’s Listings and other Advertising Materials to ensure that all Advertising Materials are current and accurate. Advertiser represents and warrants to UHNWI data that it holds and hereby grants UHNWI data all rights (including any copyright, trademark, patent, publicity or other rights) in the Advertising Materials necessary for UHNWI data to exercise its rights under the license granted in Section 2(a). Advertiser further represents and warrants to UHNWI data that: (A) all Advertiser information provided in connection with Advertiser’s account and any Ad Order is complete, correct and current; (B) the Advertising Materials comply with all policies designed to ensure compliance with civil rights and anti-discrimination laws, including, without limitation, the Fair Housing Act, Americans with Disabilities Act, and the Equal Credit Opportunity Act, and other local and international Housing Regulations, to the extent such laws are applicable to Advertiser; (C) the Advertising Materials do not indicate any discrimination on the basis of race, color, religion, sex, handicap, familial status or national origin; and (D) none of the Advertising Materials will violate or encourage violation of any applicable laws, regulations, code of conduct, or third party rights (including intellectual property rights). Violation of the foregoing may result in immediate termination of Advertiser’s Ad Order (s) and/or Advertiser’s account without notice, without limiting any other remedies available to UHNWI data.

    (ii) Non-compliant Advertising Materials. UHNWI data does not review Advertising Materials prior to display, but UHNWI data reserves the right to remove an Ad upon finding an error, violation of the Policies or this Agreement, or for any other reason. UHNWI data may send a notice to Advertiser, requiring that Advertiser modify the Advertising Materials and if Advertiser does not respond to the update request within the time frame specified and modify the Advertising Materials to comply with the notice, UHNWI data may discontinue display of the Advertising Materials without refunding any prepaid amounts to Advertiser. Advertiser may reinstate the Advertising Materials, or revise them with different content, at any time during the remainder of the term indicated in the Agreement. UHNWI data has the right, but not the obligation, to modify the Advertising Materials for format, spelling, or other matters of presentation, or to comply with the terms of this Agreement or the Policies.

    (c) Display: UHNWI data shall, for the period of time indicated in the Agreement (the “Term”), display the applicable Advertising Materials on the applicable properties on the UHNWI data Network. Advertiser may view the Term of the Ad program(s) purchased by Advertiser in Advertiser’s BBB Agent Tools dashboard. Except as specified in an Ad Order, UHNWI data will have the sole right to determine the placement and location, if any, of all or any portion of the Advertising Materials on the UHNWI data Network. For tracking purposes, UHNWI data may display a unique tracking phone number in the Ad that will directly connect to the phone number provided by Advertiser. Although an Ad Order may include an estimated number of Ad impressions that will be delivered, UHNWI data does not guarantee that any number of Ad impressions will be delivered. Advertiser understands that users of the Properties, automated computers, third parties, and UHNWI data itself may generate views, impressions or clicks on Ads for proper or improper purposes. UHNWI data has priced the Ads with this risk in mind, and Advertiser accepts this risk in purchasing an Ad. Photos provided in the Advertising Materials may not include marketing information, including, without limitation, a company name, logo, phone number and/or email address on Listing photos, whether as text a watermark, or otherwise. Further, Advertiser may not include in the screen and profile names that are provided in the Advertising Materials for display any language other than Advertiser’s name, business, team, or similar language. UHNWI data reserves the right to refuse any Ad, for any reason.

    (i) BBB Featured Ads. In the event Advertiser notifies UHNWI data that it wishes to terminate a BBB Featured Ad Order, such Ad Order will not terminate until the end of the subscription month and Advertiser agrees to pay for the remainder of the subscription month. As noted in Section 3, prepaid amounts are nonrefundable, which includes, without limitation, prepaid annual subscriptions.

    (d) Prohibited Uses. Advertiser shall not, and shall not authorize any party to: (a) generate automated, fraudulent or otherwise invalid inquiries, conversions or other actions for Advertiser’s own Listings, Ads or any other advertisements on the UHNWI data Network; (b) use any automated means of scraping or data extraction to collect data from UHNWI data Network, except as expressly permitted by UHNWI data writing; (c) create Internet “links” to the Services or “frame” or “mirror” the Services (or any portion of it); (d) attempt to disable or circumvent any technological measure UHNWI data uses to control or limit access or to protect UHNWI data’s rights; (e) use the Services in any manner which could damage, disable or overburden the Services or interfere with anyone else’s authorized use of the Services, or send or store material containing software viruses, worms, Trojan horses or other harmful code; (f) advertise anything illegal, engage in any illegal or fraudulent business practice, or induce or encourage illegal activities by third parties; (g) post any content, or engage in behavior or otherwise use the Services in a manner, that is harassing, infringing, libelous, invasive of another’s privacy, threatening, fraudulent, deceptive, obscene, or otherwise unlawful or tortious, or that would give rise to civil liability; or (h) post any content that violates Fair Housing Laws, which prohibit discrimination against any person because of Race, Color, Religion, Sex, Handicap, Familial Status, or National Origin.

    3. Payment.

    Advertiser shall be responsible for all charges displayed or otherwise described during the submission of an Ad Order and shall pay in U.S. Dollars. Prepaid amounts are not refundable. Advertiser understands and agrees that the credit card provided to UHNWI data by Advertiser will be automatically charged for all amounts owed under the Ad Order. UHNWI data may terminate your Ad Order immediately if UHNWI data is unable to process payment on the first attempt. All unpaid fees shall accrue interest at the rate of one percent (1%) per month until paid, or the legal maximum, whichever is less. Charges are exclusive of applicable taxes. Advertisers are responsible for paying (a) all taxes and any government charges, and (b) reasonable expenses (including collection agency and attorneys’ fees) UHNWI data incurs in collecting unpaid amounts. In addition to all other available rights and remedies, UHNWI data may suspend or terminate Advertiser’s Ad Order and decline to make any Services available to Advertiser in the event that UHNWI data does not receive all amounts owed by Advertiser, including, without limitation, if Advertiser requests a “chargeback”. If a fee is incurred by UHNWI data, due to billing through a third party requested by Advertiser, UHNWI data reserves the right to add such fee to the amount owed by Advertiser each month. Advertiser acknowledges and agrees that any credit card and related billing and payment information that Advertiser provides to UHNWI data may be shared with companies who work on UHNWI data’s behalf, such as payment processors and/or credit agencies, solely for the purposes of checking credit, effecting payment to UHNWI data and servicing Advertiser’s account. UHNWI data may also provide information in response to valid legal process, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims. UHNWI data shall not be liable for any use or disclosure of such information by such third parties.

    4. Term; Termination; No Refund.

    The Ad Order will last for the Term, unless earlier terminated as provided herein. After the initial Term, the Term of the Ad Order will continue on a month-to-month basis until terminated by UHNWI data or Advertiser. For Showcase, a 1 month advanced written cancellation notice is required prior to effective termination. Showcase Terminations can land mid-month, and will be pro-rated if necessary in UHNWI data’s discretion. Except as otherwise provided in the Agreement, for all other Ads and non Showcase advertising programs, Advertiser may terminate an Ad Order at any time upon providing notice to UHNWI data via email at billing@uhnwidata.com. Prepaid amounts are not refundable. UHNWI data may terminate an Ad Order or discontinue offering a BBB Ad program to Advertiser at any time for any or no reason and will provide Advertiser with notice of termination. In the event that this Agreement or a BBB Ad program is terminated, UHNWI data will not be obligated to return any Advertising Materials to Advertiser. Advertiser understands and agrees that UHNWI data will not have any liability to Advertiser or any other person for the removal of information concerning Advertiser’s account or any Advertising Materials.

    5. Modifications to Terms and/or Ads Programs.

    UHNWI data may change the terms of this Agreement at any time in its sole discretion without liability. All changes will be effective immediately upon UHNWI data providing notice by posting the revised version of the Agreement at https://www.uhnwidata.com/terms-and-conditions-of-advertising. Your use of the Services (including, without limitation, the UHNWI data Network and the BBB Ad programs) after UHNWI data provides such notice will be considered your unconditional agreement to any changes. UHNWI data further reserves the right to change or discontinue providing any BBB Ad program at any time.

    6. Indemnification.

    Advertiser agrees to indemnify and hold UHNWI data and UHNWI data’s respective officers, affiliates, successors, assigns, directors, officers, employees, agents, service providers and suppliers, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of information contained in the Advertising Materials, including without limitation, Advertiser’s Listings or information submitted, posted or made available through the UHNWI data Network by Advertiser, Advertiser’s use of the Services, Advertiser’s violation of the terms of this Agreement or any other applicable terms and conditions or Advertiser’s violation of any federal, state, local or any other laws or of any rights of any third party. Advertiser will cooperate as fully and as reasonably required in UHNWI data’s defense of any claim. UHNWI data reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Advertiser, and Advertiser shall not in any event settle any such matter without the written consent of UHNWI data.

    7. Disclaimer of Warranties.

    ADVERTISER AGREES THAT USE OF THE SERVICES ARE ENTIRELY AT ADVERTISER’S OWN RISK; AS PART OF THIS ASSUMPTION OF RISK, ADVERTISER ACKNOWLEDGES AND AGREE THAT ADVERTISER IS SOLELY RESPONSIBLE FOR EVALUATING THE LEGITIMACY AND ACCURACY OF THE ADVERTISING MATERIALS. THE SERVICES ARE PROVIDED “AS IS” “WITH ALL FAULTS” AND “AS AVAILABLE” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR THOSE ARISING BY STATUTE OR OTHERWISE IN LAW FROM A COURSE OF DEALING OR USAGE OF TRADE. UHNWI DATA DOES NOT WARRANT THAT THE AVAILABILITY OF OR THE FUNCTIONS CONTAINED IN THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SERVICE OR SERVER DO NOT VIOLATE ANY PATENT OR OTHER INTELLECTUAL PROPERTY RIGHTS OF ANY PERSON OR ENTITY. TO THE FULLEST EXTENT PERMITTED BY LAW, UHNWI DATA DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, PERFORMANCE OR RESULTS OF THE SERVICES. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT FULLY APPLY TO ADVERTISER. TO THE FULLEST EXTENT PERMITTED BY LAW, UHNWI DATA DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE SERVICES, OR ACCESSED THROUGH ANY LINKS ON THE SERVICES. ALL REPRESENTATIONS, WARRANTIES, COVENANTS AND INDEMNITIES CONTAINED IN THIS AGREEMENT SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT.

    8. Limitations of Liability.

    ADVERTISER AGREES THAT UNDER NO CIRCUMSTANCES WILL UHNWI DATA BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF UHNWI DATA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF ADVERTISER’S USE OF THE SERVICES OR SERVICES, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE UHNWI DATA NETWORK OR SERVICES, FROM INABILITY TO ACCESS THE SERVICES, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE SERVICES. SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE SERVICES OR ANY LINKS ON THE UHNWI DATA NETWORK. UHNWI DATA SHALL NOT BE RESPONSIBLE FOR ANY UNAUTHORIZED USE OF THE ADVERTISING MATERIALS BY THIRD PARTIES, INCLUDING WITHOUT LIMITATION, UNAUTHORIZED REPRODUCTION AND/OR TAMPERING BY NETWORK “HACKERS.” UHNWI DATA’S LIABILITY FOR DAMAGES RESULTING FROM THE ADVERTISING MATERIALS SHALL BE LIMITED TO THE AMOUNT IT ACTUALLY RECEIVED IN CONSIDERATION FOR PUBLISHING THE AD. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

    9. Consent.

    Advertiser agrees that UHNWI data, or a third party acting on behalf of UHNWI data, may call and/or send text messages to the telephone number(s) provided by Advertiser, including calls and text messages using an automatic telephone dialing system and/or an artificial or prerecorded voice (“Other Messages”). Advertiser further agrees that such calls and/or text messages may constitute telemarketing, e.g. UHNWI data may call with information about new service offerings available to Advertiser. Advertiser understands that agreeing to receive Other Messages that constitute telemarketing is not a condition to purchase.

    10. Authority.

    The individual or entity who submits the Ad Order (the “Authorized Signatory”) represents and warrants to UHNWI data that (i) it has the full right, power and authority to enter into this Agreement on behalf of Advertiser, to grant UHNWI data the rights and licenses set forth herein and to perform its obligations hereunder, (ii) the submission of the Ad Order by the Authorized Signatory has been duly authorized by all necessary action on the part of Advertiser, and (iii) Authorized Signatory is authorized to create a legal, valid and binding obligation on Advertiser, enforceable against Advertiser with respect to the obligations of Advertiser.

    11. Confidentiality. Confidential Information.

    Advertiser acknowledges that in connection with the execution and implementation of this advertising partnership, it may receive Confidential Information of UHNWI data. “Confidential Information” as used in this Agreement will include any and all technical and non-technical information including, copyright, trademark, trade secret and proprietary information, related to current and future proposed products or services, business strategies, details or facts contained in or related to an executed contract between Advertiser and UHNWI data and BBB Ad platform, in whatever form provided and whatever manner communicated. Confidential Information will not include information that: (A) was lawfully in the receiving party’s possession from a source other than the disclosing party before receipt from the disclosing party; (B) is or became available to the public through no fault of the receiving party and was obtained by the receiving party from such publicly available source; (C) was obtained in good faith by the receiving party from a third party who was lawfully in possession of such information; or (D) was independently developed by the receiving party, without reference to Confidential Information received hereunder. Use and Disclosure. Advertiser agrees that it will treat all Confidential Information of UHNWI data with the same degree of care as it accords to its own Confidential Information, and Advertiser represents that it exercises reasonable care to protect its own Confidential Information. Advertiser will not use Confidential Information it receives for any purpose other than for purposes permitted hereunder and will not disclose Confidential Information of the other party to any third party, other than disclosure of Confidential Information in response to a valid order by a court or other governmental body or a duly issued subpoena, or as otherwise required by law.

    12. Good Faith & Non Disparagement.

    Each Party hereby agrees that its performance of all obligations and exercise of all rights under this Agreement shall be governed by the fundamental principles of good faith and fair dealing. Further, Advertiser agrees and covenants that it will not at any time, directly or indirectly, make, publish or communicate to any person or entity or in any public forum any defamatory or disparaging remarks, comments, or statements concerning UHNWI data or its affiliated businesses, or any of its employees, officers, shareholders, members or advisors. This Section does not, in any way, restrict or impede Advertiser from exercising protected rights to the extent that such rights cannot be waived by agreement or from complying with any applicable law or regulation or a valid order of a court of competent jurisdiction or an authorized government agency, provided that such compliance does not exceed that required by the law, regulation, or order.

    13. Dispute Resolution.

    Binding Arbitration. If you reside in the United States, you and UHNWI data agree to resolve any claims relating to these Agreement or the Ads (collectively, “Disputes”) through final and binding arbitration, except as otherwise specifically provided herein.

    Waiver of Class Action. You acknowledge and agree that you and UHNWI data are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney-general action, or any other representative proceeding. Further, unless both you and UHNWI data otherwise agree in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of any class or representative proceeding. If this specific paragraph is held unenforceable, then the entirety of this “Dispute Resolution” section will be deemed void. Except as provided in the preceding sentence, this “Dispute Resolution” section will survive any termination of this Agreement.

    Arbitration Rules and Governing Law. This agreement to arbitrate evidence of a transaction in interstate commerce, and thus the Federal Arbitration Act (the “FAA”) governs the interpretation and enforcement of this provision. The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified by this “Dispute Resolution” section. (The AAA Rules are available at www.adr.org/arb_med) If the FAA and AAA Rules are found not to apply to any Dispute hereunder, or the enforcement thereof, then that issue shall be resolved under the laws of the State of New York without giving effect without giving effect to its conflict of laws provisions.

    Notice; Informal Dispute Resolution. A party who intends to seek arbitration must first send written notice to the other party by certified email. Notice to UHNWI data, should be sent to legal@uhnwidata.com. Your notice must include (a) your name, postal address, telephone number, email address, (b) a description in reasonable detail of the nature or basis of the Dispute, and (c) the specific relief that you are seeking. UHNWI data’s notice to you will be sent electronically to the email address UHNWI data has on file associated with your UHNWI data account, and will include (a) our name, postal address, telephone number and an email address at which UHNWI data can be contacted with respect to the Dispute, (b) a description in reasonable detail of the nature or basis of the Dispute, and (c) the specific relief that UHNWI data is seeking.

    If you and UHNWI data cannot agree how to resolve the Dispute within thirty (30) days after the date notice is received by the applicable party, then either you or UHNWI data may, as appropriate and in accordance with this Agreement, commence an arbitration proceeding.

    Arbitration Process. A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules. (The AAA provides a form Demand for Arbitration.) The arbitrator will be either a retired judge or an attorney licensed to practice law in the State of New York and will be selected by the parties from the AAA’s roster of consumer dispute arbitrators. If the parties are unable to agree upon an arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the arbitrator in accordance with the AAA Rules.

    Arbitration Location and Procedure. Unless you and UHNWI data otherwise agree, the arbitration will be conducted in New York County, New York and the state and federal courts located in New York County, New York shall have exclusive jurisdiction over any appeals and the enforcement of an arbitration award.

    If the Dispute does not exceed $10,000, you or UHNWI data may elect to have the arbitration conducted by telephone or based solely on written submissions, which election shall be binding on you and UHNWI data subject to the arbitrator’s discretion to require an in-person hearing, if the circumstances warrant. In cases where an in-person hearing is held, you and/or UHNWI data may attend by telephone, unless the arbitrator requires otherwise. If the Dispute exceeds $10,000, the right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.

    Arbitrator’s Decision. The arbitrator will render an award within the time frame specified in the AAA Rules. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitrator’s award damages must be consistent with the terms of the “Liability Limitation; Exclusive Remedy” section as to the types and the amounts of damages for which a party may be held liable. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant’s individual claim. The prevailing party shall be entitled to an award of reasonable attorney fees.

    Fees. Your responsibility to pay any AAA filing, administrative and arbitrator fees will be solely as set forth in the AAA Rules.

    Changes. Notwithstanding the provisions of the “Changes; Discontinuance” section, if UHNWI data changes this “Dispute Resolution” section after the date you last accepted this Agreement (or accepted any subsequent changes to this Agreement), you may reject any such change by sending us written notice (including by email) within 30 days of the date such change became effective, as indicated in the “Last Updated” date above or in the date of UHNWI data’s email to you notifying you of such change. By rejecting any change, you are agreeing that you will resolve any Dispute between you and UHNWI data in accordance with the provisions of this “Dispute Resolution” section as of the date you last accepted this Agreement (or accepted any subsequent changes to this Agreement).

    Exceptions to Agreement to Arbitrate. Either party may bring a lawsuit solely for injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights without first engaging in arbitration or the informal dispute-resolution process described above. If the agreement to arbitrate is found not to apply to you or your claim, you agree to the exclusive jurisdiction of the state and federal courts in New York County, New York to resolve your claim.

    14. Miscellaneous.

    Except as preempted by the FAA, this Agreement is governed by the laws of the State of New York, without giving effect to its conflict of laws provisions. Each party agrees to submit to exclusive jurisdiction and venue in the state and federal courts sitting in New York County, New York for any actions for which the parties retain the right to seek injunctive of other equitable relief. In any dispute arising under this Agreement, the prevailing party will be entitled to attorneys’ fees and expenses. This Agreement, including the corresponding Ad Order(s), constitutes the entire and exclusive agreement between the parties with respect to the subject matter hereof, and supersedes and replaces any other agreements, terms and conditions applicable to the subject matter hereof. Except as otherwise provided herein, any notices to UHNWI data must be sent to email legal@uhnwidata.com and are deemed given upon confirmation from UHNWI data employee or legal representative of the email receipt. Notice to Advertiser may be effected by sending an email to the email address specified in Advertiser’s account, or by posting a message to Advertiser’s account interface, and is deemed received when sent (for email) or no more than fifteen (15) days after having been posted (for a message). A waiver of any default is not a waiver of any subsequent default. Subject to the Dispute Resolution provision, unenforceable provisions will be modified to reflect the parties’ intention and only to the extent necessary to make them enforceable, and remaining provisions of the Agreement will remain in full effect. Advertiser may not assign any of its rights hereunder and any such attempt is void. UHNWI data and Advertiser are independent contractors, not legal partners or agents.

    Welcome and thank you for your interest in UHNWI data and the UHNWI data family of businesses (UHNWI data and its affiliated brands listed in Section 2, collectively, the “UHNWI data Companies,” “us,” “our,” or “we” ). By clicking a registration or new account submission button, or by otherwise using our websites, networks, mobile applications, or other services provided by the UHNWI data Companies (collectively, the “Services”), or accessing any content provided by us through the Services, you agree to be bound by the following terms of use, as updated from time to time (the “Terms of Use”).

    1. UHNWI data Companies’ Role.

    The UHNWI data Companies, and the Services, may assist you in performing the various tasks in high value transactions. However, unless explicitly specified by the terms of use for a particular Service (each a “Product’s Terms”), THE SERVICES ARE NOT INTENDED TO provide you with any financial, marketing, legal or related advice of any kind. You understand and agree that the Services may include advertisements. To help make the advertisements relevant and useful to you, the UHNWI data Companies may serve advertisements based on the information we collect through the Services. See our Privacy Policy for more details.

    2. UHNWI data Companies’ Brands and Businesses.

    We operate the following affiliated brands, any use of any of the Services provided by the following affiliated brands is subject to these Terms of Use: (a) UHNWI data; (b) Billionaires' Bulletin Board (“BBB”). Services offered by each of these companies may be subject to additional terms of use as available on their respective websites, networks, mobile applications, or otherwise.

    A. Affiliated Business Relationship Notice: This is to give you notice of business relationships among the following providers. UHNWI data. (“UHNWI data” which operates uhnwidata.com and promotes UHNWI data Offers, among other programs); Billionaires' Bulletin Board (“BBB”) are each indirectly wholly owned by UHNWI data. through one or more subsidiaries. Because of these relationships, any referrals of you by any of the ZUHNWI data Companies may provide the referred company, its direct or indirect parent (including UHNWI data), and our respective employees with a financial or other benefit.

    3. Eligibility; Accounts and Registration.

    You must be at least 18 years of age to use the Services. By agreeing to these Terms of Use, you represent and warrant that: (a) you are at least 18 years of age; (b) you have not previously been suspended or removed from the Services; and (c) your registration and your use of the Services complies with all applicable laws and regulations. To access some features of the Services, you may be required to register for an account and agree to a Product’s Terms, to the extent applicable to that service, which may be incorporated herein or available on a separate UHNWI data Companies site. When you register for an account you will be asked to provide us with some information about yourself, such as email address, phone number, or other contact information. You agree that the information you provide is accurate and that you will keep it accurate and up-to-date at all times. When you register, you will be asked to provide a password. You are solely responsible for maintaining the confidentiality of your account and password, and you are responsible for all actions taken via your account. You may not share your user account(s) with others. Unless you have entered into a commercial agreement with us permitting you to use the Services for transactions on behalf of another person, you may use the Services only for transactions on your own behalf.

    4. Use of the Services; Restrictions.

    A. Use of the Services. As long as you comply with these Terms of Use, we grant you a non-exclusive, limited, revocable, personal, non-transferable license to use the Services for your personal use. If you are acting in your professional capacity, you may additionally use the Services to provide information, to the extent permitted by applicable law, to your clients.

    B. Use of Content. Subject to the restrictions set forth in these Terms of Use, you may copy information from the Services without the aid of any automated processes and only as necessary for your personal use to view, save, print and/or e-mail such information. You are prohibited from displaying any other UHNWI data Companies’ data without our prior written approval.

    5. Prohibited Use.

    BY USING THE SERVICES, YOU AGREE NOT TO:

    reproduce, modify, distribute, display or otherwise provide access to, create derivative works from, decompile, disassemble, or reverse engineer any portion of the Services, except as explicitly permitted by any Product’s Terms to the extent applicable to that product’s Services;

    provide/post/authorize a link to any of the Services (including but not limited to a customer account page) from a third-party website or institutions;

    remove or modify any copyright or other intellectual property notices that appear in the Services;

    use the Services in any way that is unlawful, or harms the UHNWI data Companies, its service providers, suppliers, affiliates, or any other user;

    use the Services in any way to discriminate against any individual or class of individuals protected under federal, state or local laws, or which may have a discriminatory impact against any individual or class of individuals, or which otherwise promotes illegal, racist or discriminatory activities or outcomes;

    distribute or post spam or other unsolicited messages, chain letters, pyramid schemes, or similar communications through the Services;

    impersonate another person, misrepresent your affiliation with another person or entity, or make any representation to any third party under false pretenses;

    reproduce, publicly display, or otherwise make accessible on or through any other website, application, or service any reviews, ratings, or profile information about similar to UHNWI data and BBB platform services, or other professionals providing such services, or other data or content available through the Services, except as explicitly permitted by us for a particular portion of the Services;

    upload invalid data, viruses, worms, or other software agents to the Services;

    post, reproduce, publicly display, or otherwise make accessible any content, which we, in our sole judgment and discretion, consider illegal, offensive or objectionable including without limitation content that harasses, discriminates, demeans, threatens or disparages any individual or class of individuals;

    interfere with, or compromise the system integrity or security of the Services, or otherwise bypass any measures we may use to prevent or restrict access to the Services;

    conduct automated queries (including screen and database scraping, spiders, robots, crawlers, bypassing “captcha” or similar precautions, or any other automated activity with the purpose of obtaining information from the Services) on the Services;

    use any of the UHNWI data Companies’ trademarks as part of your screen name or email address on the Services;

    access or use any of the Services to develop competitive products or services; or

    attempt to, or permit or encourage any third party to, do any of the above.

    6. Fees.

    You will be required to pay fees to access certain features of the Services. All fees are in U.S. dollars and are non-refundable. If we change the fees for all or part of any of the Services, including by adding fees or charges, we will provide you advance notice of those changes. If you do not accept the changes, we may discontinue providing the applicable part of the Services to you. Our authorized third-party payment processors will charge the payment method you specified at the time of purchase or as agreed to as part of the selected Service. You authorize us to charge all fees as described in these Terms of Use for the Services you select to that payment method. If you pay any fees with a credit card, we may seek pre-authorization of your credit card account before your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover your purchase.

    B. Subscriptions.

    The Services may include features that allow for automatically recurring payments for periodic charges (“Subscription Service”). If you decide to activate a Subscription Service, you authorize us to periodically charge, on a going-forward basis and until cancellation of either the recurring payments or your account, all accrued sums on or before the payment due date for the accrued sums. The subscription will continue unless and until you cancel your subscription, or we terminate it. You must cancel your Subscription Service before it renews in order to avoid billing of the next periodic subscription fee to your account. We will bill the periodic subscription fee to the payment method you provide to us during registration (or to a different payment method if you change your payment information). We may change the subscription fee for any subsequent subscription period but will provide you advance notice of any increase before it applies. Unless otherwise stated in your Product’s Terms, you may cancel a Subscription Service through the settings page in your account, by contacting us at billing@uhnwidata.com

    7. User Materials.

    A. UGC Definition; License Grant. Certain portions of the Services may allow users to upload or otherwise provide the UHNWI data Companies images, photos, video, data, text, listings, and other content (“User Materials”). Absent any additional terms provided in your Product’s Terms, by uploading or otherwise providing User Materials to the Services, you grant us an irrevocable, perpetual, royalty-free worldwide license to: (i) use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, prepare derivative works of or incorporate into other works, and translate your User Materials, in connection with the Services or in any other media; and (ii) sublicense these rights, to the maximum extent permitted by applicable law. We will not pay you for your User Materials or to exercise any rights related to your User Materials set forth in the preceding sentence. We may remove or modify your User Materials at any time. You are solely responsible for all User Materials made through your user account(s) on the Services or that you otherwise make available through the Services. For all User Materials, you represent and warrant that you are the creator and owner of the User Materials, or have the necessary licenses, rights, consents, and permissions (including all permissions required under applicable privacy and intellectual property law) to authorize the UHNWI data Companies and other users to access and use your User Materials as necessary to exercise the licenses granted by you under these Terms of Use. We will not use client contact information that is uploaded by Advertisers into the UHNWI data website or connected Third-Party Providers for any purpose, unless that client contact information is otherwise provided to us directly by the client.

    B. UGC Disclaimer. We are under no obligation to edit or control your User Materials or the User Materials of any other User and will not be in any way responsible or liable for any User Materials. We may, however, at any time and without prior notice, screen, remove, edit, or block any User content on the Services, including User Materials, that in our sole judgment violates these Terms of Use or we find otherwise objectionable, including any violation of our Listings Quality Policy or Advertising Terms of Service. You understand that when using the Services, you may be exposed to User Materials of other users and acknowledge that User Materials may be inaccurate, offensive, indecent, or objectionable. You agree to waive, and do waive, any legal or equitable right or remedy you may have against us with respect to User Materials. We expressly disclaim any and all liability in connection with User Materials. If notified by a user or content owner that User Materials allegedly do not conform with these Terms of Use, we may investigate the allegation and determine in our sole discretion whether to remove those User Materials, which we reserve the right to do at any time and without notice. For more information on our handling of infringing content, please see Section 11 below.

    8. Third Party/Linked Services/Sent information.

    A. Generally. The Services include links to third-party products, services, and websites, as well as materials provided by third parties, and may include functionality that allows for the distribution of your User Materials or your personal information (collectively, your “User Information”) to third parties not under our control (each, a “Third-Party Provider”). Third-Party Providers are solely responsible for their services. You are responsible for your use and submission of User Information to any third party, and your dealings or business conducted with any third party arising in connection with the Services are solely between you and such third party. Your use of third-party sites, services, or products may be subject to associated third-party terms of use and privacy policies or other agreements, which you are solely responsible for complying with. We do not endorse, and take no responsibility for such products, services, Web sites, and materials, or a Third-Party Provider’s use of your User Information. By using a tool that allows for User Information to be transferred, you agree that we may transfer the applicable User Information or other information to the applicable third-parties, which are not under our control. If you submit a contact form or otherwise indicate your interest in contacting a Third-Party Provider, you may receive telemarketing calls from the Third-Party Provider using the contact information you provided. Third-Party Providers may keep your contact information and any other information received by the Third-Party Provider in processing a contact or other request form. We are not responsible for any damages or costs of any type arising out of or in any way connected with your dealings with these third parties.

    B. Certain Third-Party Services.

    (i) Referrals and Lead Sales. As part of the Services, you may be connected with industry professionals. You authorize us to make such referral or lead sale and acknowledge that we may be paid valuable consideration for facilitating such connection. As part of the Services, you may be connected to a party that provides a set of specific services matching our advertising sections. If any of these parties have an affiliated relationship with any of the UHNWI data Companies, then one or more of the UHNWI data Companies may receive a financial or other benefit from the referral between such affiliates

    (ii) Non-Affiliated Provider. If you choose to contact a non-affiliated provider through the Services by filling out a contact, other request form or otherwise indicating your interest in contacting (or being contacted by) a Third-Party Provider on the Services, you authorize the UHNWI data Companies, and UHNWI data in particular to provide the information you submit to the Third-Party Provider. If you include your name, contact information and other information in a request, your identity will no longer be anonymous to the Third-Party Provider. Decisions in any related non-affiliated transactions are made by participating Third-Party Providers and are not made by the UHNWI data Companies and the UHNWI data Companies are not responsible for the decisions of any Third-Party Provider.

    C. Additional Terms for Third Party Services.

    Certain aspects of the Services include Third-Party tools that are subject to additional Third-Party terms, including, but not limited to, the following:

    (i) Squarespace, Inc. is an American website building and hosting company. Terms of Use available at https://www.squarespace.com/terms-of-service

    (i) Google Maps. Some of the Services implement the Google Maps web mapping service. Your use of Google Maps is subject to Google’s terms of use, available at http://www.google.com/intl/en_us/help/terms_maps.html, and Google’s Privacy Policy, available at https://www.google.com/intl/ALL/policies/privacy/index.html.

    (iii) Stripe. Some of the Services allow you to use Stripe Connect to make payments to other users, and may include additional processing or application fees detailed when you choose to connect to Stripe. Your use of Stripe is subject to the Stripe Connected Account Agreement, available at https://stripe.com/us/connect-account/legal. Additionally, by using Stripe, you agree not to use Stripe (and the Services generally) for any Prohibited Business purposes, as listed at https://stripe.com/us/prohibited-businesses.

    9. Intellectual Property.

    The Services are owned and operated by the UHNWI data Companies. The user interfaces, design, information, data, code, products, software, graphics, and all other elements of the Services (the “UHNWI data Companies’ Materials”) that we provide are protected by intellectual property and other laws and are the property of the UHNWI data Companies or the UHNWI data Companies’ Third-Party licensors. Except as expressly allowed by these Terms of Use, you may not make use of the UHNWI data Companies’ Materials, and the UHNWI data Companies reserve all rights to the UHNWI data Companies’ Materials and Services not granted expressly in these Terms of Use.

    Intellectual Property Notices:

    Certain content on the Services is owned by Squarespace, Inc. The names of actual companies, products, and services mentioned herein may be the trademarks of their respective owners. Any rights not expressly granted herein are reserved. We do not assert copyright or grant any rights to the underlying images or descriptions of Ad listings provided through the Services. Any use of these images and descriptions is subject to the copyright owner’s permission and the requirements of applicable law.

    10. Feedback.

    If you choose to provide input and suggestions regarding the Services, including related to any of the UHNWI data Companies’ Materials (“Feedback”), then you hereby grant us an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner and for any purpose, including to improve the Services or create other products and services.

    11. DMCA; Claims of Copyright Infringement.

    We respect the intellectual property rights of others and ask that everyone using the Services do the same. Anyone who believes that their work has been reproduced on the Services in a way that constitutes copyright infringement may notify our copyright agent in accordance with Title 17, United States Code, Section 512(c)(2), by providing the following information:

    (i) Identification of the copyrighted work that you claim has been infringed;

    (ii) Identification of the material that you claim is infringing and needs to be removed, including a description of where it is located on the Services so that the copyright agent can locate it;

    (iii) Your address, telephone number, and, if available, e-mail address, so that the copyright agent may contact you about your complaint; and

    (iv) A signed statement that the above information is accurate; that you have a good faith belief that the identified use of the material is not authorized by the copyright owner, its agent, or the law; and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf in this situation.

    Except as stated in any Product’s Terms, you may request to deactivate your account at any time by sending email to deactivate@uhnwidata.com. You can delete your account and all your account data by sending a request to “delete your data” at privacy@uhnwidata.com. If you deactivate or delete your account, you remain obligated to pay all outstanding fees, if any, incurred prior to termination relating to your use of the Services. If you violate any provision of these Terms of Use, your permission from the UHNWI data Companies to use the Services will terminate automatically. In addition, we may, in our sole discretion, deactivate, suspend, or terminate your access to your account and the Services at any time for any reason, with or without notice. We may alter, suspend, or discontinue the Services or any portion of the Services without notice. We will not be liable whatsoever for any change to the Services or any suspension or termination of your access to, or use of the Services. We reserve the right to change these Terms of Use at any time in its sole discretion on a going-forward basis, and we will make commercially reasonable efforts to notify you of any material changes to these Terms of Use. Your continued use of the Services after any updates are effective will represent your agreement to the revised version of the Terms of Use and will constitute acceptance of, and agreement to, any such changes. You further waive any right you may have to receive specific notice of such changes to these Terms of Use. You are responsible for regularly reviewing these Terms of Use.

    13. Privacy Policy/Other Terms.

    A. Privacy Policy. The UHNWI data Companies will collect, use, store, and disclose personal information in accordance with our Privacy Policy. Please consult your Privacy Policy for more information, which is incorporated into, and made a part of, these Terms of Use.

    B. Other Terms. Your use of the Services is subject to all additional guidelines, rules, Product Terms, and agreements applicable to the Services or certain features of the Services that we may post on, or link to, from the Services, such as rules applicable to a particular product or content available through the Services, including, without limitation, the Listing Quality Policy, Advertising Terms and Conditions and UHNWI data Terms of Services. All such terms are incorporated into, and made a part of, these Terms of Use.

    14. Indemnification.

    You agree to indemnify, defend, and hold harmless the UHNWI data Companies, our affiliates, and our respective directors, officers, employees, and agents from any and all claims and demands made by any third party due to or arising out of: (a) your access to or use of the Services; (b) your breach of these Terms of Use; (c) your violation of any law or the rights of a third party; (d) any dispute or issue between you and any third party; (e) any User Materials you upload to, or otherwise make available through, the Services; (f) your willful misconduct; and (g) any other party’s access to or use of the Services using your account and password. The UHNWI data Companies reserve the right, at their own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in that case, you agree to cooperate with the UHNWI data Companies’ defense of that claim.

    15. No Warranties.

    THE UHNWI DATA COMPANIES PROVIDE THE SERVICES “AS IS,” “WITH ALL FAULTS” AND “AS AVAILABLE,” AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE UHNWI DATA COMPANIES AND OUR SUPPLIERS MAKE NO REPRESENTATIONS, WARRANTIES, OR CONDITIONS, EXPRESS OR IMPLIED. THE UHNWI DATA COMPANIES AND OUR SUPPLIERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS, STATUTORY, AND IMPLIED, INCLUDING WITHOUT LIMITATION: (A) WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, ACCURACY, TITLE, QUIET ENJOYMENT, NO ENCUMBRANCES, NO LIENS, AND NON-INFRINGEMENT; (B) WARRANTIES OR CONDITIONS ARISING THROUGH COURSE OF DEALING OR USAGE OF TRADE; AND (C) WARRANTIES OR CONDITIONS OF UNINTERRUPTED OR ERROR-FREE ACCESS OR USE. YOU ASSUME ALL RISK FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OF OR ACCESS TO THE SERVICES, YOUR DEALING WITH ANY OTHER USER, AND ANY MATERIALS, INCLUDING ALL USER AND UHNWI DATA COMPANIES’ MATERIALS, AVAILABLE THROUGH THE SERVICES.     IN NO EVENT WILL THE UHNWI DATA COMPANIES OR ANY OF OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF, BASED ON, OR RESULTING FROM THESE TERMS OF USE OR YOUR USE OR ACCESS, OR INABILITY TO USE OR ACCESS, THE SERVICES OR ANY MATERIALS ON THE SERVICES, WHETHER BASED ON: (A) BREACH OF CONTRACT; (B) BREACH OF WARRANTY; (C) NEGLIGENCE; OR (D) ANY OTHER CAUSE OF ACTION, EVEN IF THE UHNWI DATA COMPANIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE UHNWI DATA COMPANIES ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF MATERIALS; (II) PERSONAL INJURY OR DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICES; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY MATERIALS OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY MATERIALS POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES; OR (VII) USER MATERIALS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. THE AGGREGATE LIABILITY OF THE UHNWI DATA COMPANIES AND ANY OF OUR AFFILIATES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, ANY PORTION OF THE SERVICES OR OTHERWISE UNDER THESE TERMS OF USE, WHETHER UNDER CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (1) THE AMOUNT YOU HAVE PAID TO THE UHNWI DATA COMPANIES FOR THE SERVICES IN THE 12 MONTHS PRIOR TO THE EVENTS OR CIRCUMSTANCES GIVING RISE TO THE CLAIMS; OR (2) $100. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL DAMAGES. ACCORDINGLY, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.     These Terms of Use are governed by the laws of the State of New York, without giving effect to its conflict of laws provisions. You agree to submit to the personal and exclusive jurisdiction and venue in the state and federal courts sitting in New York County, New York for all disputes, claims, and actions arising from or in connection with the Services or otherwise under these Terms of Use. The UHNWI data Companies operate the Services from New York remotely and we make no representation that the Services are appropriate or available for use in other locations.

    18. General.

    You agree not to export from anywhere any part of the Services provided to you, or any direct product thereof, except in compliance with, and with all licenses and approvals required under, applicable export laws, rules and regulations. All Services used by the U.S. Government are provided with the commercial license rights described herein. These Terms of Use may be amended only by a written agreement signed by authorized representatives of the parties to these Terms of Use. If any part of these Terms of Use is determined to be invalid or unenforceable, then the invalid or unenforceable provision will be replaced with a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Use will continue in effect. The section titles in these Terms of Use are used solely for the convenience of the parties and have no legal or contractual significance. We may assign this Agreement, in whole or in part, at any time with or without notice to you. You may not assign these Terms of Use, or assign, transfer or sublicense your rights, if any, in the Services. Our failure to act with respect to a breach, or our choice to otherwise waive breach by you or others, does not waive our right to act with respect to subsequent or similar breaches. Except as expressly stated herein, these Terms of Use, and all expressly incorporated terms and agreements, constitute the entire agreement between you and the UHNWI data Companies with respect to the Services and supersede all prior or contemporaneous communications of any kind between you and the UHNWI data Companies with respect to the Services. The following sections of these Terms of Use shall survive any termination of these Terms of Use: 3, 5-8, 10-12, and 14-21.

    19. Consent to Communications.

    By using the Services, you consent to receiving certain electronic communications from us as further described in the Privacy Policy. Please read our Privacy Policy to learn more. You agree that any notices, agreements, disclosures, surveys, or other communications that we send to you electronically will satisfy any legal communication requirements, including that those communications be in writing.

    The Services may provide web forms, links, or contact information, including phone numbers, that can connect you with the UHNWI data Companies or third parties, such as real estate agents and Third-Party Providers. Communications through these methods may be routed through a third-party service (“Communications Service”). Calls may be recorded or monitored for quality assurance, training, or customer service purposes. You will be notified at the beginning of a call if it may be recorded or monitored. You consent to such recording and monitoring by the UHNWI data Companies or the Communications Service. We also use the Communications Service to track text messages between you and potential clients so that we and the clients can access certain details about the contact. As part of this process, we and the Communications Service will receive in real time, and store, data about your text message, including the date and time of the text message, clients email address, and the content of the text message. You consent to these practices by us and the Communications Service. The information is subject to the Privacy Policy.

    What is Personal Data?

    Information You Give Us or Create Using Our Services

    Collection of Personal Data

    When you use our services or website we collect personal data from you. We might also collect personal data about you from our business partners, payment processors, service providers, and other third parties who collect personal data on our behalf. This information might include:

    Account Registration and Profile Information: If you register for an account through our services or complete a UHNWI data profile, we collect account identifiers (including a username and password, as well as internal identifiers we assign to individual accounts to allow our systems to connect account information stored in different databases) and account history and records (including services you’ve used or interacted with, the date and type of account creation, account status, log in activity, transactions, the services we provide, messages received in connection with the services, and your activity on our websites and mobile applications). We use this information to create and administer your account, provide you with the relevant services and information, communicate with you regarding your account and your use of the services, for customer support purposes, and to send you communications by email, push notification, or by text message, in accordance with your preferences.

    Customer Service and Communication History: Including name, address, email, customer service requests, Account Identifiers, Account History and the contents of requests and correspondence with us (including recordings of phone calls, where permitted by law).

    Feedback Information: If you submit a review, feedback or other comments, we collect your contact information (such as first and last name, email address, and phone number) and any feedback and ratings relating to our services and products, including reviews you create for products and services.

    Inquiries and Communication: If you communicate with us or otherwise submit an inquiry or question (e.g., via webform), we collect your contact information (such as first and last name, email address, and phone number), account identifiers and history (described above), and any other personal data you choose to provide in the content of your message or communication. We use this information to investigate and respond to your inquiries, to facilitate communication with us, to provide you with requested information, to enhance the services we offer, and to manage and grow our business. If you represent a company or agency interested in partnering with us, we will also collect your professional and employment information in order to respond to your inquiries, communicate with you, to manage and grow our organization and to facilitate a business relationship. Our websites and online services provide you the ability to connect with us through an online web form that collects contact information (such as first and last name, email address, phone number, company name, and title with company), area(s) of interest or concern, and a custom message.

    Location Data: Including general geographic location reflected in the Log Data we collect or more precise location when you choose to share it with us through your device or browser settings.

    Newsletters and Email Communication: Many of our websites and online services provide you an opportunity to sign up for our newsletters and email communications by providing your email address. We use your email address to communicate with you about our services and exciting developments at UHNWI data, which may include marketing communications. Please see the “Choices About Your Data” section below for additional information about opting out of our marketing communications.

    Payment Information: We and our third-party service providers collect information relating to your transactions with us, including details regarding payments you’ve made through our sites. We use third-party payment tools to process and store payment information like credit card numbers or bank account information. We don’t store this information ourselves.

    Although we often collect the personal data described above directly from you, we may also collect certain information through our business partners, service providers, and other third parties that collect it on our behalf, such as communications providers, data brokers, payment processors, payment system providers, and information technology providers.

    Other Collection of Personal Data

    In addition to the personal data collected above, we may also collect personal data as follows:

    Affiliates: We may receive information about you collected by other UHNWI data companies, businesses, brands, and affiliated entities in our family of companies, so that information you provide to one brand may be used by us to better provide you services and communicate with you.

    Business Partners: Our business partners, such as sales agents, advertisers, service providers, collect personal data in connection with their products and services and often share some or all of this information with us. For example, we receive information about transactions you complete with partners with whom we’ve connected you through our services or BBB platform.

    Business Representatives: We collect professional personal data about representatives of third-party businesses, including representatives of our customers and business partners, in connection with our services and the operation of our business, which may include:

    Contact Information: Including full name, email address, mailing address, and telephone number.

    Professional Information: Including job title, job function, company name and characteristics, professional background, and nature of the relationship with us.

    Payment Information: Including bank account information, and payment information where you are a representative of a sole proprietor or similar legal structure that uses account information in lieu of separate business information.

    Inquiry Information: Including the contents of emails, texts, and other communications and, where permitted by law, recordings of calls with us.

    Feedback Information, including information provided in response to surveys we may conduct with customers or business partners, or unsolicited feedback received regarding our services and business.

    Service Providers: Our service providers, such as payment processors and marketing providers, collect personal data and often share some or all of this information with us. For example, we receive personal data from payment processors to confirm that an individual’s payment for the services was accepted.     Information Providers: We may from time to time obtain information from third-party information providers to correct or supplement personal data we collect. For example, we may obtain updated contact information from third-party information providers to reconnect with you.

    Publicly Available Information: We may collect personal data from publicly available sources through our wealth intelligence and research team, such as information you publicly post or tag us in on social media sites or elsewhere online, and information contained in public records databases, such as government records or public review websites, to supplement the personal data identified above.     Our Disclosure of Personal Data

    We disclose your personal data in the following ways:

    Within UHNWI data: We are able to offer the products and services we make available because of the hard work of the entire UHNWI data team. UHNWI data entities disclose your personal data to other UHNWI data entities for purposes and uses that are consistent with this Privacy Notice and applicable law. For example, one part of UHNWI data might share your personal data with another in order to ensure that all the people helping in your search or advertising are working together for you.

    Business Partners: At your direction, we may share your personal data with our business partners in order to provide you with our products and services. For example, if you ask us to, we’ll share your contact information with potential buyers, advertisers or other relevant BBB platform’s or UHNWI data website visitors.

    Marketing Partners: We coordinate and share your personal data with our marketing partners, including advertising networks, social networks, and marketing communication providers, in order to communicate with you about our products and services and market our products and services to you. We may also share aggregated demographic information with third parties interested in advertising on our online services to assist them in understanding the audience they would be reaching, but this information is not designed to identify any specific individual.

    Service Providers: We share information with third party vendors and service providers that perform services for or on our behalf, which may include identifying and serving targeted advertisements, providing mailing or email services, tax and accounting services, customer service, product fulfillment, payments processing, photo sharing, data processing and enhancement services, fraud prevention, web hosting, analytic services, or other online functionality, subject to appropriate contractual terms protecting the confidentiality and use of such data. We never allow service providers to use your personal data for their own purposes.

    Business Transaction or Reorganization: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose your personal data to a third party during negotiation of, in connection with, or as an asset in such a corporate business transaction. Your personal data may also be disclosed in the event of insolvency, bankruptcy, or receivership.

    Otherwise with Consent or At Your Direction: We may disclose your personal data to certain other third parties or publicly with your consent or direction. If you post a comment or review our website or a comment on our social media sites, the information you provide may be displayed publicly online for others to view.

    Choices About Your Data

    Profile Access and Data Sharing. You may access and update your profile information, such as your user name, address, or billing information, and may change some of your data sharing preferences on your account page.

    Location and Device Permissions. You may control location tracking by adjusting your location services options on the “Settings” app on your mobile device. We may continue to approximate your location based on your IP address when you access the services through a computer or device. If you would like to update your device content access permissions, such as permissions to access your camera, you can do so in the “Settings” app on your mobile device.

    Promotional Messages. You can stop receiving promotional email communications from us by following the “unsubscribe” instructions provided in such communications. We make every effort to promptly process all unsubscribe requests. You may still receive service-related communications, including account verification, transactional communications, changes/updates to features of the services, and technical and security notices.

    Third Party Tracking and Interest-Based Advertising. We participate in interest-based advertising and use third party advertising companies to serve you targeted advertisements based on your browsing history.     Third-Party Tracking and Interest-Based Advertising

    We may participate in interest-based advertising and use third party advertising companies to serve you targeted advertisements based on your browsing history. We may permit third party online advertising networks, social media companies, and other third-party services to collect information about your use of our websites over time so that they may play or display ads on our services, on other websites, apps, or services you may use, and on other devices you may use. Typically, though not always, the information used for interest-based advertising is collected through tracking technologies, such as cookies, Flash objects, web beacons, embedded scripts, mobile SDKs, location-identifying technologies, and similar technology (collectively, “tracking technologies”), which recognize the device you are using and collect information, including clickstream information, browser type, time and date you visited the site, device ID or AdID, geolocation, and other information. We may share a common account identifier (such as an e-mail address or user ID) or hashed data with our third-party advertising partners to help identify you across devices. We may share a common account identifier (such as a hashed email address or user ID) or work with third-party partners who use tracking technologies or statistical modeling tools to determine if two or more devices are linked to a single user or household. We, and our partners, can use this cross-device linkage to serve interest-based advertising and other personalized content to you across your devices (including to improve your user experience), to perform analytics, and to measure the performance of our advertising campaigns.

    In some of our offerings we provide you with the option of logging in using an account that you may have with a social-media service, such as Apple, Google, or Facebook. For this type of log-in, you will be directed to the appropriate social-media login page, where you will enter your username and password (or account credentials) for the social-media service. (Through a social-media login, the social media service may know when you have used our offering.) The social media-service will then send us a token, which we will use to authenticate you for access. The social-media service may also share your name and email address with us, although we will not have access to your social-media account credentials. We may keep the token and your name and email address for purposes of identifying you, which enables us to maintain your preferences in our offering across different devices. As an example, by identifying you using this information, we can present to you your previous searches. Keeping this information also makes it possible for us to pre-populate your name and email in certain interfaces, such as login fields or contact forms.

    Your Choices

    Sensitive Information

    The following personal data elements we collect may be classified as “sensitive” under certain privacy laws (“sensitive information”):

    “Shine the Light”

    California residents that have an established business relationship with us have rights to know how their personal data is disclosed to third parties for their direct marketing purposes under California’s “Shine the Light” law, or the right to opt out of such practices (Civ. Code §1798.83).

    Depending on your state of residence, you may also have the right to not receive retaliatory or discriminatory treatment in connection with a request to exercise the above rights.     Submitting Privacy Rights Requests

    We may need to verify your identity before processing your request. In order to submit a request, you’ll need to log in to your account with us so we can verify your identity. If you can’t log in or don’t have an account, we may not be able to link you to any personal data of yours on our systems, but we’ll do our best. In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems. We will use personal data provided in connection with a Rights Request only to review and comply with the request.

    To Exercise Your Right to Opt-Out of Personal Data Sales or Sharing for Targeted Advertising

    Unless you have exercised your Right to Opt-Out, we may disclose your personal data to third parties who may use such information for their own purposes in accordance with their own privacy policies. Under some state laws, disclosing personal data for online advertising like this may be considered a “sale of personal data” or “sharing for targeted advertising.”

    UHNWI data allows certain companies to place tracking technologies like cookies and pixels on our sites, which allow those companies to receive information about your activity on the UHNWI data website or BBB platform that is associated with your browser or device. The companies may use that data to serve you more relevant ads on our sites or others. Except for this kind of selling or sharing, UHNWI data doesn’t otherwise sell any of your personal data.     You do not need to create an account with us to exercise your Right to Opt-Out.     Appealing Privacy Rights Decisions

    Minors

    We do not sell the personal data of consumers we know to be less than 18 years of age, unless we receive affirmative authorization (the “Right to Opt In”) from either the minor who is between 16 and 18 years of age, or the parent or guardian of a minor less than 16 years of age.

    If you are under the age of 18 and you want to remove your name or comments from our website or publicly displayed content, please contact us directly at privacy@uhnwidata.com. We may not be able to modify or delete your information in all circumstances.

    If you wish to submit a privacy request on behalf of your minor child in accordance with applicable jurisdictional laws, you must provide sufficient information to allow us to reasonably verify your child is the person about whom we collected personal information and you are authorized to submit the request on your child’s behalf (i.e., you are the child’s legal guardian or authorized representative).

    California Categories of Personal Data

    California law requires we provide disclosures to you about what personal data we collect by reference to the enumerated categories of personal data set forth within California law. To address this obligation, we have identified the relevant enumerated California personal data category for the personal data, sources and purposes described in the “Our Collection and Use of Personal Data” section of our Privacy Notice below:

    Identifiers, including Account Registration and Profile Information, information related to your feedback, inquiries, and communications, credit and identity information relating to data used to identify you, full name, IP address, and government identification number (including Social Security number, passport number, and driver’s license number).

    Customer Records, including Account Registration and Profile Information, Security/Authentication Information, and Payment Information.

    Protected Classification Characteristics, including age, date of birth, gender, and sex.

    Commercial Information, including Account Registration and Profile Information relating to your purchases, Profile Information relating to your transactions, preferences, and interests, and Feedback Information.

    Internet/Network Information, including information about how you access and use the services, Log Data, and Analytics Data.

    Geolocation Data, including general geographic location or more precise location with your consent or when permitted by law.

    Inferences, including our predictions about interests and preferences and related Service Profile Information.

    We collect this data from the following sources: directly from you, from our business partners and affiliates, from your browser or device when you visit our mobile app(s) or use our Services, or from third parties that you permit to share information with us. Please see “Our Collection and Use of Personal Data” section of our Privacy Notice for more information about the sources of personal data we collect. We disclose all of these categories of personal data for a business purpose to service providers or other third parties at the consumer’s direction, as outlined in the “Our Disclosure of Personal Data” section of our Privacy Notice.

    Retention of Personal Data

    We strive to retain your personal data only for as long as is reasonably necessary to fulfill the purpose for which it was collected. However, if necessary, we may retain your personal data for longer periods of time, until set retention periods and deadlines expire, for instance where we are required to do so in accordance with legal, tax and/or accounting requirements set by a legislature, regulator, or other government authority.

    To determine the appropriate duration of the retention of personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of personal data and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting, and other applicable obligations.

    Therefore, we retain personal data for as long as you use our services for the purposes explained in our Privacy Notice, including maintaining a user account. When you discontinue the use of our services, we will retain your personal data for as long as necessary to comply with our legal obligations, to resolve disputes and defend claims, as well as for any additional purpose based on the choices you have made, such as to receive marketing communications.

    Once retention of your personal data is no longer necessary for the purposes outlined above, we will either delete or de-identify the personal data or, if this is not possible (for example, because personal data has been stored in backup archives), then we will securely store your personal data and isolate it from further processing until deletion or deidentification is possible.

    “Shine the Light” Disclosures

    The California “Shine the Light” law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes.     User Notice Policy

    Before we produce information in response to a request, we will attempt to notify affected users and give them an opportunity to object unless notification is prohibited by law or court order or if we believe that notification would create a risk of harm or be otherwise counterproductive. Non-disclosure instructions contained in legal requests must cite appropriate authority.

    Government and Law Enforcement Agency Requests

    UHNWI data accepts service of subpoenas, search warrants, and court orders seeking production of documents by email from government and law enforcement agencies. Requests must be submitted to government@uhnwidata.com or law_enforcement@uhnwidata.com from an official government or law enforcement agency email address. We will not accept service of legal process sent to this mailbox from non-government or non-law enforcement email addresses.

    Requests should be accompanied by information about the agency and specific officer or attorney making the request sufficient to allow UHNWI data to verify the request. Requests must also be facially valid and, if applicable, identify the relevant user(s) with specificity. We require a search warrant based on probable cause to release most user account content.

    Private Party Requests

    UHNWI data accepts civil subpoenas for user data issued by New York County Superior Court and the federal courts in New York state. All subpoenas issued by civil litigants seeking UHNWI data user information must be served electronically at government@uhnwidata.com. UHNWI data does not accept service by mail or fax.

    UHNWI data reviews all requests for user data carefully to ensure that a valid legal basis exists for the request and will challenge requests that we deem vague, overbroad, or lacking a proper legal basis. Requests must be facially valid and, if applicable, must identify the relevant user(s) with specificity. Before issuing a subpoena, parties should ensure that the information sought is not already available publicly on UHNWI data websites or on the internet.
