UHNWI Direct - Terms and Conditions
1. Introduction
Welcome to UHNWI Direct, a service provided by UHNWI Data. By using our platform, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.
2. Service Description
UHNWI Direct facilitates the transmission of information to Ultra High Net Worth Individuals (UHNWIs) through a secure and efficient routing system. Our Wealth Intelligence Team identifies and updates contact information to the best of our knowledge, ensuring high accuracy and relevance.
3. Responsibilities
Provider Responsibilities: We strive to provide accurate and up-to-date contact information for UHNWIs. Our data is regularly updated and verified; however, we cannot guarantee 100% accuracy due to potential changes made by the recipients.
User Responsibilities: Users must provide accurate and appropriate message content and comply with our communication policies.
4. Message Processing
Review: All messages undergo a basic review for compliance with our policies.
Rejection: Messages that violate our policies will be rejected, and no refund will be issued.
Approval: Approved messages will be sent to the recipient through available communication channels.
Confirmation: Users will receive an electronic confirmation once the message has been dispatched.
Payment: Transmission of the message is contingent upon the receipt of the applicable service fee.
5. Recipient Responses
Direct Responses: Recipients may respond directly to the user’s message using the contact details provided by the user.
Indirect Responses: Recipients may respond through the UHNWI Direct platform. In this case, the recipient’s reply will be routed to the user within 24 hours.
No Obligation to Respond: Recipients are under no obligation to reply to messages. Neither the administration of the UHNWI Direct platform nor users can compel recipients to respond.
6. Fees and Payment
Service Fee: Each message dispatch incurs a fee of $15 USD plus applicable taxes.
No Obligation to Transmit the Message: Payment of the service fee by users of the UHNWI Direct platform does not impose any obligation on the platform and its administration to dispatch the message. The platform reserves the right to reject any submitted content without providing an explanation if it is determined, based on internal review, that the content violates our communication policy or internal ethical standards. Users are encouraged to carefully consider the information they submit.
Refund Policy: No refunds will be provided for dispatched or rejected messages, or if the recipient does not respond.
Please note: The full name of the UHNWI Direct service user (the individual submitting the contact form) must match the name of the payee specified in the billing details at checkout. Ensure that this information is accurate prior to making a payment. Any discrepancy between the user name and the payee name will result in the rejection of the message transmission, and no refund will be issued.
7. Messaging Limits
Frequency: Users can send one message per 24-hour period to any specific recipient.
Bulk Messaging: For sending messages to more than 100 recipients, users should use the digital content distribution feature.
8. Confidentiality
Data Protection: All information contained in your routing request is protected and will not be disclosed.
Intellectual Property: We acknowledge your intellectual property rights and will not use the information for our own benefit or that of third parties.
9. UHNWI Search
Service Description: UHNWI Search is a solution for finding contact information on the UHNWI individual you are looking for. Users can submit a request (free of charge), and our experienced Wealth Intelligence Team will find or add the profile from our own database to UHNWI Direct, enabling you to establish contact.
Connecting with UHNWIs: To connect with the individual, users must utilize the UHNWI Direct service. The request itself does not provide a free option to connect.
10. Affiliate Program
Overview: The UHNWI Direct Affiliate Program allows individuals to earn passive income by submitting verified contact information of ultra-high-net-worth individuals (UHNWIs) to our platform. These individuals typically include billionaires (over $1B net worth), centi-millionaires (over $100M net worth), and multi-millionaires (over $50M net worth).
Eligibility: Individuals with verified contact information for persons with a net worth exceeding $50M can become partners.
Verification Process: Our Wealth Intelligence Team will verify the provided data. Once confirmed, the submitted information will be made available to platform users and eligible for monetization.
Commission: Partners will receive 70% of the message fee for each message sent using their provided information, minus transaction costs and taxes. Payment gateway fees: what Stripe, PayPal, Squarespace.
Payment: Commissions are paid every 30 days via bank transfer or PayPal.
Completion of Program: The affiliate program will be concluded if the provided contact information of UHNWIs is no longer accurate due to changes or other circumstances. Members of the affiliate program will be notified of these changes. If a member of the affiliate program has uploaded multiple contact information for UHNWIs, the payments for the remaining accurate contacts will not be affected.
11. Indemnification
User Indemnification: Users agree to indemnify, defend, and hold harmless UHNWI Direct, its affiliates, officers, directors, employees, agents, and third parties from and against any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to the user’s violation of these terms, use of the platform, or any unlawful or negligent actions.
12. Limitation of Liability
Exclusion of Damages: In no event shall UHNWI Direct be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
13. Dispute Resolution
Arbitration: Any disputes arising out of or in connection with these terms and conditions shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New York County, New York, USA.
Class Action Waiver: Users agree to resolve disputes with UHNWI Direct on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Termination
Termination by UHNWI Direct: UHNWI Direct reserves the right to terminate or suspend your account and access to the service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these terms.
Effect of Termination: Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service.
15. Force Majeure
Force Majeure Events: UHNWI Direct shall not be liable for any failure to perform its obligations hereunder where the failure results from any cause beyond UHNWI Direct’s reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation.
16. Entire Agreement
Entire Agreement Clause: These terms constitute the entire agreement between you and UHNWI Direct regarding the use of the service and supersede any prior agreements between you and UHNWI Direct.
17. Severability
Severability Clause: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18. No Waiver
No Waiver Clause: UHNWI Direct’s failure to enforce any right or provision of these terms will not be considered a waiver of those rights.
19. Amendments
UHNWI Direct reserves the right to amend these terms and conditions at any time. Users will be notified of any significant changes.
20. Authorization to Contact UHNWIs
By using our service, users officially authorize the UHNWI Direct communication team to contact the chosen UHNWI individual on their behalf.
21. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of New York County, New York, USA. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of New York County, New York, USA.
